LaBlast Instructor Membership in LIF

All certified LaBlast® Instructors are automatically enrolled as members of LIF and governed by the LIF agreement. This allows LaBlast® to make certain you have access to all the membership benefits. When you enroll in a LaBlast® certification to become a Certified LaBlast Instructor, you agree you are also enrolling in LIF membership, cancellation of your monthly LIF membership will result in a loss of your certification. LaBlast® knows that part of being a successful instructor is being committed. Once you enroll for the certification, membership for the first three months is non-cancellable and included for free in your enrollment in a LaBlast Certification. You agree that your LaBlast Certification fee is due in full upon your enrollment in a LaBlast class. LaBlast believes this commitment is an important part of the process, as is knowing LaBlast LIF benefits are there for you every day.

Following the LaBlast certification, your email will be added to receive the monthy newsletter, the LaBulletin, to be kept up to date on all new things. You may receive other emails and promotions through this emailing newsletter. You may unsubscribe at any time.

LaBlast Instructor Certification payment can be as follows:

• $249 prior to instructor certification and at full cost, OR a $199 discounted early-bird rate (Availability subject to change)
• After your initial two months, the membership fee for LaBlast Instructor Foundation or “LIF” is $30/month and is due upon your third month anniversary and continues monthly until manual cancellation via your account or written consent to info@lablastfitness.com.
• You can be certified in 4 LaBlast^® formats (Fitness, Splash, Chair Fitness, and Kids Fitness) and still only pay $30/month*.  That means even more LIF videos and playlists at your disposal, for the same price.
• Kids Fitness holds its own monthly subscription as a $15 add-on for current LIF members, or $30 solo.

You agree not to terminate, contest, or block monthly LaBlast re-occurring charges, and to update your credit card information as needed. You acknowledge that the LaBlast fee is earned upon enrollment.

LIF Membership Cancellation

If you purchased the LaBlast® Certification at the $199/$249 rate, you may cancel Your LIF membership any time after the first two months by visiting your LaBlast Account on our website www.lablastfitness.com , and adjusting your membership settings.

Subscription Services

Each month of LIF Fitness you will receive: (only applicable to Fitness certified Instructors)

• 2 fully-choreographed routines to your favorite music.
• 2 Playlists, jam-packed with music that will motivate and move your students to a selection of at least dances.  Each playlist is carefully crafted to maximize interval properties of LaBlast Fitness. (1 Playlist for Splash, Chair Fitness & Kids Fitness)
• Bonus Content – Throughout the year you will receive extra bonus material.
• Online access to marketing materials to help create class demand and a professionally designed business card template.

LaBlast On-Demand Monthly Membership

The LaBlast Fitness On-Demand membership has access to monthly workout videos and Health and Wellness tips. It’s important to note that LaBlast On-Demand Monthly membership is not associated with any certification and stands on its own as a subscription to those who wish to workout with Louis and Master Trainers directly or in addition to your LIF subscription as additional content to learn from.

There are three (2) LaBlast Fitness On-Demand memberships. Basic ($14.95/month). Unlimited ($29.95/month).

LaBlast On-Demand Membership Cancellation

You may cancel your LaBlast On-Demand Membership at any time. It will take 3-5 business days to complete the cancellation.

Merchandise

LaBlast related clothing sales depend upon our affiliate and inventory availability, order deadlines, and in some cases the shipping address. They are limited to certain products sold by LaBlast and its affiliates (or third-party sellers participating in LaBlast). Products eligible for LIF discount will be designated as such on their product pages. Some special product, order, handling fees, and/or taxes may still apply to eligible purchases. If only some items in your order are eligible for LIF, You will pay applicable shipping charges for both and list price for the ineligible items.

Other Benefits

LaBlast is committed to continuing to enhance the value and experience of being a LaBlast Certified Instructor. From time to time, LaBlast will offer other benefits and opportunities to our family of LaBlast Certified Instructors.

Other Limitations

• LaBlast reserves the right to accept or refuse membership at its discretion.
• LaBlast may send you emails and other communications related to LIF and your LIF membership (regardless of any settings or preferences related to your LaBlast account).
• You may not transfer or assign your LIF membership or any LIF benefits except as allowed in these terms.
• From time to time, LaBlast may choose at its sole discretion to add or remove LIF membership benefits.

Fees and Renewal

The membership fee for LIF is $30 per month and is due upon your third month anniversary (although as a courtesy, LaBlast has set up a reoccurring monthly charge). From time to time, LaBlast may offer different membership terms, and the fees for such membership may vary. The LIF membership fee is non-refundable except as expressly set forth in these Terms. Taxes may apply on either or both of the membership fee and the benefits and products offered.

Only credit cards are eligible for payment of your LIF membership. Do not sign up for LIF with a debit card (also known as a “check” or “ATM” card, a debit card typically has the word “debit” printed on the face of the card).

If all credit cards LaBlast has on file for you are declined for payment of your membership fee, you must provide LaBlast a new credit card promptly or your membership will be canceled and PAYMENT IN FULL will be due for the remaining unpaid portion of your LIF membership fee. If you provide LaBlast with a new card and are successfully charged, your new membership period will be based on the original renewal date and not the date of the successful charge.

YOU UNDERSTAND YOUR LIF MEMBERSHIP WILL AUTOMATICALLY CONTINUE AND YOU AUTHORIZE LABLAST (WITHOUT NOTICE TO YOU, UNLESS REQUIRED BY APPLICABLE LAW) TO COLLECT THE INSTALLMENT MEMBERSHIP FEE AND ANY TAXES, USING ANY CREDIT CARD LABLAST HAS ON RECORD FOR YOU.

Promotional Trial Memberships

We sometimes offer certain customers various trial or other promotional memberships, which are subject to these Terms except as otherwise stated in the promotional offers. Trial members may at any time (through your Account) choose not to continue paid membership at the end of the trial period. Trial LIF members must have written confirmation from LaBlast of such terms.

Agreement Changes

LaBlast may, at its discretion, change these Terms, LaBlast’s Conditions of Use and Privacy Notice, or any aspect of LIF membership, without notice. If any change to these terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions. YOUR CONTINUED MEMBERSHIP AFTER WE CHANGE THESE TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST CANCEL YOUR MEMBERSHIP.

Termination by LaBlast

LaBlast may terminate your LIF membership at its discretion without notice. If LaBlast does so, LaBlast may suspend the monthly collection. However, LaBlast will not give any refund for termination related to conduct that it determine, in its discretion, violates these Terms or any applicable law, involves fraud or misuse of the LIF membership, or is harmful to its interests or another LaBlast Instructor, web site user, or LaBlast student. LaBlast’s failure to insist upon or enforce your strict compliance with these Terms will not constitute a waiver of any of LaBlast’s rights.

Limitation of Liability

IN ADDITION TO OTHER LIMITATIONS AND EXCLUSIONS IN LABLAST’S CONDITIONS OF USE, IN NO EVENT WILL LABLAST OR ITS MEMBERS, MANAGERS, INVESTORS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, ATTORNEYS OR OTHER REPRESENTATIVES BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, ARISING OUT OF OR RELATED TO LABLAST. LABLAST’S TOTAL LIABILITY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WILL NOT EXCEED SIX MONTHS’ MEMBERSHIP FEE. THESE EXCLUSIONS AND LIMITATIONS OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND WILL SURVIVE CANCELLATION OR TERMINATION OF YOUR LIF MEMBERSHIP. CERTAIN STATE LAWS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.

LaBlast Fitness, LaBlast Splash, LaBlast Line Dance, Etc.

LIF members certified in other areas besides LaBlast Fitness are subject to all of the above Terms, except as explained in this paragraph. From time to time, LaBlast may offer different LIF membership terms, and the fees for such membership may vary. LIF members in such programs will also be governed by other applicable fees, terms, conditions, limitations, and requirements.

Disputes

The parties agree that in the event of any dispute or claim arising out of or relating to LaBlast or any of its affiliates, members, instructors, licensees, subcontractors or agents, with the exception of membership or other fee payment due to the Company, the parties agree first to try in good faith to settle the dispute by mediation administered by the American Arbitration Association under its Commercial Mediation Procedures before resorting to arbitration, litigation, or some other dispute resolution procedure. If they do not reach such solution within a period of 60 days, then, upon notice by either party to the other, all disputes, claims, questions, or differences (other than fee payment due the company) shall be finally settled by arbitration administered by the American Arbitration Association in accordance with the provisions of its Commercial Arbitration Rules. Arbitration shall take place in Salt Lake City, Utah. Judgment on any arbitration award may be entered in any court having jurisdiction. You agree that no claim arising out of services rendered pursuant to this agreement shall be asserted more than one year after the date of the last payment by Member.
